General Terms and Conditions (GTC) of Ticketticker GbR for ticket purchases via ticketticker.de

1. Scope and definitions
- These GTC apply to the use of the online platform ticketticker.de and to ticket orders by consumers and businesses via the platform, unless expressly agreed otherwise.
- “Organizer” means the provider of the event (e.g., concert/festival) who is responsible for the content, schedule, and execution of the event.
- “Customer” means the person who orders tickets via Ticketticker.
- “Ticket” means the right of admission to the event (e-ticket/print@home, mobile ticket, hard ticket), potentially personalized.
2. Role of Ticketticker / Contracting party
- As a rule, Ticketticker is not the organizer of the offered events, but provides services – depending on the event – as an intermediary and/or processing service provider (pre-sale, payment processing, ticket provisioning and delivery).
- The contract for attending the event is concluded between the customer and the respective organizer.
- In individual cases, Ticketticker may act as seller in its own name if this is explicitly indicated in checkout/for the event. In this case, Ticketticker is the contractual partner for the ticket purchase.
3. Offer, ordering process, conclusion of contract
- The presentation of tickets/events on the platform does not constitute a legally binding offer, but an invitation to place an order.
- The customer selects tickets, enters the required data, and completes the purchase via the order button in accordance with Section 312j German Civil Code (BGB) in checkout.
- The contract for Ticketticker’s service (processing/intermediation) is concluded as soon as Ticketticker confirms the order by email (order confirmation) or provides the ticket – whichever occurs first.
- The customer must check the order confirmation and event details immediately upon receipt and report any errors without undue delay.
4. Customer account, data, reachability
- Registration may be required for certain functions. The customer must provide truthful and complete information and keep changes up to date.
- The customer is responsible for ensuring that the provided email address is reachable and that emails (e.g., ticket delivery, information regarding postponement/cancellation) can be received (spam filter, mailbox capacity).
5. Prices, fees, payment methods
- The ticket prices shown during checkout apply, including statutory VAT (where applicable) and any service/system/pre-sale fees and shipping costs.
- Ticketticker may offer various payment methods (e.g., bank transfer, PayPal, Sofort/Klarna, credit card, or other payment services). The options available in checkout are decisive.
- If a payment service provider is used, its terms may apply; any additional costs will be shown during checkout.
6. Delivery / ticket provision
- E-tickets / mobile tickets are usually provided electronically after successful payment (e.g., by email and/or download link in the customer account).
- Hard tickets – where offered – are shipped to the delivery address specified during checkout. Delivery times are non-binding estimates unless explicitly promised as binding.
- The customer is responsible for correctly providing delivery and contact details.
- In case of non-delivery due to incorrect address data or non-collection/refusal of acceptance, Ticketticker may charge a reasonable processing fee for re-shipment; details and amount are communicated in advance.
7. Personalized tickets, re-personalization, misuse
- Tickets may be personalized. The information in the ordering process and on the ticket is decisive.
- Re-personalization is only possible if offered for the respective event. Any conditions (deadlines, fees, evidence) are shown in the relevant process.
- The customer must protect tickets against loss, third-party access, copying, and other misuse. As a rule, one ticket grants entry only once.
- In case of suspected misuse (e.g., duplicates, manipulation), tickets may be blocked; further rights of the organizer (house rules) remain unaffected.
8. No right of withdrawal for tickets
- For contracts regarding services related to leisure activities, if the contract provides for a specific date or period, there is no right of withdrawal (Section 312g para. 2 no. 9 BGB).
- Where Ticketticker acts exclusively as intermediary, the exclusion of the right of withdrawal also applies to the intermediation service.
- Ticket purchases are therefore generally binding and non-cancellable after completion unless explicitly offered otherwise in individual cases (e.g., ticket insurance, goodwill policy).
9. Cancellation, postponement, program changes, force majeure
- As a rule, the organizer informs Ticketticker about cancellations or postponements; Ticketticker forwards information to customers where available. Ticketticker is not obliged to inform independently about changes unless such changes were communicated by the organizer.
- In case of cancellation or postponement, customer claims (e.g., refund of ticket price) are generally directed against the organizer, unless Ticketticker is explicitly the seller itself.
- Whether and to what extent service/system/pre-sale fees are refunded depends on the conditions shown at purchase and on the legal/contractual classification of those fees.
- Program/cast changes may occur and do not automatically justify a refund claim; the organizer’s rules and applicable law are decisive.
10. Liability of Ticketticker
- Ticketticker has unlimited liability for intent and gross negligence, and for damage resulting from injury to life, body, or health.
- Liability for damage arising from injury to life, body, or health and under the Product Liability Act remains unaffected.
- In case of slightly negligent breach of essential contractual obligations (cardinal obligations), Ticketticker’s liability is limited to foreseeable damage typical for the contract.
- Otherwise, liability is excluded to the extent legally permissible.
- Ticketticker is not liable for the execution, quality, content, or legal admissibility of the event; the organizer is responsible for this.
- Ticketticker is not liable for disruptions outside its control (e.g., internet/network disruptions, third-party systems), to the extent legally permissible.
- For shipping services, transport risk and replacement are governed by statutory provisions and by the shipping provider’s conditions; details depend on the selected shipping method.
11. Platform availability
Ticketticker strives for high platform availability but cannot completely exclude maintenance, updates, or disruptions. There is no claim to uninterrupted availability.
12. Data protection
Information on the processing of personal data can be found in the Privacy Policy on ticketticker.de: https://www.ticketticker.de/privacy.
13. Online dispute resolution / consumer dispute resolution
- The European Commission provides a platform for online dispute resolution (ODR).
- Ticketticker does not participate in dispute resolution proceedings before a consumer arbitration board.
14. Final provisions
- German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
- If the customer is a merchant/business, the place of jurisdiction – where permissible – is Ticketticker’s registered office.
- If individual provisions are invalid, the validity of the remaining provisions remains unaffected (the statutory provision replaces the invalid provision).
